California AB 802

California’s statewide Building Energy Benchmarking program was established by Assembly Bill 802, passed in 2015. AB 802 requires that “Disclosable Buildings” submit an Energy Star Benchmark report, due June 1 annually. Disclosable buildings are defined as:

  Commercial buildings larger than 50,000 sq ft.
• 
  Residential or mixed-use buildings larger than 50,000 sqft, with more than 17 residential units.

Condominium projects are exempt from the benchmarking requirement. Buildings that consist of at least 50% laboratory or industrial use are also exempt. However, for the purposes of AB 802, warehousing and distribution centers are not considered industrial, and therefore must submit an annual benchmarking report.

Berkeley BESO

Berkeley’s Building Energy Saving Ordinance (BESO) requires non-residential and multifamily residential buildings larger than 25,000 sqft to submit an Energy Star Benchmark report, due July 1 annually. The ordinance also requires an Energy Assessment to be conducted every 5 years, though this requirement is waived if the building’s Energy Star benchmark score is 80 or higher. An Energy Assessment consists of a comprehensive survey of a building’s heating, cooling, lighting, and other energy-using systems, to identify improvements to operations or equipment that would result in reduced energy usage.

Buildings up to 25,000 sqft are not subject to an annual benchmarking requirement, however Energy Assessments are required at the time of sale. The seller of the building may have an assessment performed, or may defer responsibility to the buyer. If the time of sale assessment is deferred, the buyer must have an assessment performed within 12 months of purchase.

BESO additionally requires buildings up to 25,000 sqft to conduct an Energy Assessment every 10 years. Residential buildings with 1-4 units are exempted from this requirement. This requirement is currently being phased in on the following schedule:

California Green Building Standards Code

CALGreen is California’s first green building code and first in the nation state-mandated green building code. It is formally known as the California Green Building Standards Code, Title 24, Part 11, of the California Code of Regulations .

The purpose of CALGreen is to improve public health, safety, and general welfare through enhanced design and construction of buildings using concepts which reduce negative impacts and promote those principles which have a positive environmental impact and encourage sustainable construction practices.
